Terms of Service

These Terms of Service (“Terms”) govern your access to and use of www.tradingsmarter.online (the “Website”) and the software, downloads, licensing, and related services we provide (together, the “Services”), including Trading Smarter for MetaTrader 5 (“MT5”).

By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services

1: Company Information

Trading Smarter is software for MT5 which may include:

  • Trading Smarter Indicator (analysis, structure tools, signals/alerts)
  • Trading Smarter Trader EA (automation/execution — available only on eligible plans)

Trading Smarter is not a broker, does not hold client funds, and does not provide investment services.

The Services are operated by GASM Smartdrivers LLC (“we”, “us”, “our”), located in Muscat, Sultanate of Oman.

2: What Trading Smarter Is

Trading Smarter is a proprietary trading software built for MetaTrader 5 (MT5). It provides analysis tools, structure identification, alerts, and optional automated trade execution depending on your plan. The software does not act as a broker or hold funds. All trading decisions, risk management, and results remain solely the responsibility of the user.

3: No Financial Advice / No Guarantees

All content and software are provided for educational and informational purposes only and do not constitute investment, financial, tax, or legal advice.

Trading involves risk. You may lose some or all of your capital. We do not guarantee any profits or results. Please review our Risk Disclosure.

4: Eligibility

You must be legally able to enter a binding agreement to use the Services. If you use the Services on behalf of a business, you confirm you have authority to bind that business.

5: Accounts, Access, and Licensing

  • Some features require a valid purchase, subscription, or license key.
  • Features may vary by plan/tier.
  • If your license is invalid, expired, or your plan does not include automation, the EA may block new trades.
  • You are responsible for keeping your license key and account access secure and not sharing it with others.
  • We may use technical checks to validate licensing and prevent abuse.

6: Software License (What You Are Allowed to Do)

Subject to these Terms and your plan, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the software for your personal use or internal business use.

You may not:

  • share, sell, sublicense, rent, lease, or redistribute the software or license key
  • reverse engineer, decompile, disassemble, or bypass protections (except where legally permitted)
  • copy or republish documentation, presets, indicators, templates, or materials as your own product without written permission

7: Acceptable Use

You must not:

  • use the Services unlawfully
  • interfere with licensing, servers, or platform operation
  • attempt unauthorized access to systems/accounts
  • upload malicious code or exploit vulnerabilities
  • market the software as “guaranteed profit” or as regulated advisory services

We may suspend or terminate access if we believe these Terms are violated.

8: Payments, Subscriptions, and Billing

Payments for the Services are processed through OUR payment gateway, which may act as the Merchant of Record for your purchase.

  • Prices and billing frequency are displayed at checkout.
  • You authorize charges according to your selected plan.
  • You are responsible for any applicable taxes or fees handled through the checkout process.

Managing Subscriptions

You can manage or cancel your subscription using the “Manage subscription” link in your purchase email (OUR payment gateway customer portal). Cancellation stops future billing and access continues until the end of the current billing period unless stated otherwise.

9: Refunds

Refunds are governed by our Refund Policy (linked on the Website). Where local consumer laws provide mandatory rights, those rights apply.

10: Updates and Changes

We may update, modify, or discontinue parts of the Services at any time, including features, pricing, tiers, and compatibility. We do not guarantee compatibility with every broker, symbol specification, or MT5 update

11: Third-Party Services (MT5, Brokers, VPS)

Your use may depend on third-party services (MetaTrader 5, your broker, VPS providers, internet providers). We are not responsible for:

  • spreads, slippage, requotes, execution delays
  • broker restrictions, symbol rules, server outages
  • MT5 issues, connectivity issues, VPS downtime

12: Intellectual Property

The Services, software, branding, and documentation are owned by GASM smartdrivers LLC (or licensors). You receive a license to use the software; you do not receive ownership.

13: Disclaimers

The Services are provided “AS IS” and “AS AVAILABLE.” We disclaim warranties to the fullest extent permitted by law, including merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant uninterrupted operation, error-free functionality, or that alerts/signals will always

trigger in every broker condition

14: Limitation of Liability

To the fullest extent permitted by law, we are not liable for:

  • trading losses, lost profits, lost opportunities
  • indirect, incidental, or consequential damages
  • broker/platform/outage-related issues

Our total liability for any claim relating to the Services is limited to the amount you paid for the Services in the previous 30 days (or USD 100 if you paid nothing), whichever is higher, unless applicable law requires otherwise.

15: Indemnity

You agree to indemnify and hold us harmless from claims, losses, and expenses arising from your misuse of the Services, violation of these Terms, or violation of any law or third-party rights.

16: Suspension and Termination

We may suspend or terminate your access if:

  • you violate these Terms
  • we detect abuse, key sharing, fraud, or chargeback misuse
  • payments fail or are reversed

You may stop using the Services at any time. Obligations incurred before termination remain payable.

17: Governing Law and Disputes

These Terms are governed by the laws of the Sultanate of Oman. Any dispute will be handled by the competent courts in Muscat, Oman, unless mandatory consumer laws apply.
